This article outlines the scheduling and cancellation policies for hosted proceedings in Depositions by Filevine. To ensure adequate coverage, smooth operation, and fairness to our attendees and team, we have established the following policies for scheduled proceedings.
Scheduling Policies
Hosted proceedings can be scheduled Monday through Friday from 8 am to 6 pm in the time zone of the event, with the exception of most US federal holidays. These proceedings can be as short as 15 minutes or up to 8 hours. To request a hosted proceeding outside of these hours, email our team at depositions@filevine.com.
Advance notice is required for hosted proceedings. The minimum notice depends on whether a proceeding is remote (hosted virtually through Zoom) or in-person:
- Remote: 1 full business day
- In-Person: 5 full business days
For instance, a remote proceeding on Monday at 9 am must be scheduled no later than Friday at 9 am.
Heads Up!
Coverage is only guaranteed when the minimum notice requirement is met. While we can attempt to accommodate last-minute requests, we cannot guarantee coverage without sufficient notice. It is recommended to schedule proceedings as early as possible to secure your preferred reporters and vendors.
Cancellation Policies
Advance notice is required before canceling or rescheduling hosted proceedings. The minimum notice depends on whether the proceeding includes a third-party vendor, like an interpreter:
- With third-party vendor(s): 2 full business days (fees and policies are determined by the vendor and are subject to change)
- Without third-party vendor(s): Before 5:00 pm local time on the business day preceding the event
Canceling or rescheduling proceedings without meeting the minimum notice requirement will incur a fee.
If you (the scheduling party) fail to attend a scheduled event, the following policies apply depending on the event duration.
- Events longer than 30 minutes: failure to appear within 30 minutes of the event start time will incur a fee.
- Events 30 minutes or shorter: failure to appear within 15 minutes of the event start time will incur a fee.
Certificate of Non-Appearance
If the witness fails to attend a scheduled proceeding, let the reporter know you’d like to order a Certificate of Non-Appearance (CNA)—a formal document certifying that the witness was not present for a proceeding.
The reporter will prepare and sign the CNA, typically within one business day. You will receive an email notification once the CNA is available in your account.
To download the CNA in Depositions by Filevine, go to the Cases section and select the case where the proceeding was scheduled. The proceeding’s folder will display CNA under the name of the proceeding. Find the document named certificate_of_non_appearance.pdf. Click the ellipsis icon ⋯ next to the file and select Download. You can then file this certificate with the court.
